This
site was inspired by an interracial couple’s incredible story of their ongoing
eight-year battle against their local government, that lead them to learn how
to thoroughly research and present the legal issues in court themselves. Three
years ago, a Bergen County Judge ruled that Bergen does NOT have to follow the
law. By combining the legal issues discoveries of the case facts and history of
a small piece of property in question, they continue to oppose Bergen in
appellate courts, and to expose the truth. The more zealously they prove what
they know - within the system, the more aggressively County officials and
attorney pursue winning at all costs; using all their advantages, influence and
resources in order to prevent the truth of this case from ever seeing the light
of day.
The
couple, if ultimately forced to forfeit the small parcel, will suffer financial
devastation, but a personal nightmare is only part of what drives their
unbreakable determination to change the outcome. Their quest for justice has evolved
into a mission to preserve property ownership rights for ALL NJ Property
Owners, since their research lead them to an astonishing discovery - the law
used against them was old law. It was based on the state of the law in 1991, which
soon changed. Three Supreme Court Rulings from that year caused the Legislature
to enact new law just months later. Since 1992 - the law reflects quite
differently.The
new controlling law, as of 1992, protects property owners and other parties the
government might choose to sue over other issues, by stating that government IS
subject to the law. So the bigger problem presented here, is that ultimately
the courts may ignore the law, in order to favor the government. If they do,
then the law becomes meaningless as if it’s reversed, which it was not; NJ
property owners lose protective rights and worse - all citizens have much at
stake if the courts can not be held to follow the law.
Continue
on to Our Story to understand how this case defied reason and
common sense since it began with Bergen demanding a piece of property back
after 50 years, that caused harm or interference to no one. Bergen admitted
having no need and no intention for use and never explained its motive for
suing. Form your own opinion as to whether this 8 plus year dispute belongs in
the courts or whether it could have been resolved over in an amicable discussion.
